
The National Agency for the Settlement of Complaints was established in accordance with Law No. 131 of July 3, 2015, on public procurement, as an autonomous and independent public authority with respect to other public authorities, individuals, and legal entities. It reviews complaints in the framework of public procurement procedures.
The Agency has organizational, functional, operational, and financial independence, and is not subordinate to any other authority or public institution, having the duty to protect the legitimate rights and interests of all parties involved in the complaints submitted for resolution, without any favoritism or discrimination.
The National Agency for the Settlement of Complaints is apolitical, does not support or assist any political party, and carries out its competencies respecting the principles of independence and tenure stability of the complaints resolution advisors, as well as the principles of transparency and impartiality in decision-making.
The procedure for examining and resolving complaints is carried out according to the law, respecting the principles of legality, expedience, adversarial process, and the right to a defense.
The Agency's structure includes seven advisers for resolving complaints, including the General Director and the Deputy General Director, who hold the status of public dignity functions and review complaints through panels of three members.
Advisers are appointed by Parliament with the majority of votes of the present deputies, upon the proposal of the Parliament's Commission for Economy, Budget, and Finance, their selection being based on professional aptitudes, as a result of an open, impartial, and transparent contest, organized by the Commission for Economy, Budget, and Finance.
