TERMS AND CONDITIONS OF USE OF THE JOBBER PLATFORM

BY A SPECIFIC ACTION CONSTITUTING UNAMBIGUOUS CONSENT (FOR EXAMPLE, BY CHECKING A DEDICATED BOX "I HAVE READ AND AGREE TO THE JOBBER TERMS AND CONDITIONS"),

BY CHECKING THIS BOX, THE USER:

A. EXPRESSLY GIVES ITS CONSENT TO COMPLY WITH ALL PROVISIONS OF THESE TERMS AND CONDITIONS, AS WELL AS ANY OTHER TERMS AND CONDITIONS APPLICABLE TO THE SERVICES;

B. ACKNOWLEDGES THE TERMS OF PROCESSING OF PERSONAL DATA IN ACCORDANCE WITH THE PRIVACY POLICY, WHICH IS AN INTEGRAL PART OF THESE TERMS AND CONDITIONS.

To ensure compliance with the conditions of access to and use of the Services, Users are obliged to review the terms and conditions of use upon each access to the Jobber Platform.

If You have not familiarized Yourself with the terms and conditions but use the Jobber.md Platform as a User (Employer or Candidate), we will consider that You have accepted this set of Terms and Conditions (including any updates thereto).

If You do not agree with the provisions of these Terms and Conditions (including any updates thereto), we ask You not to use or to cease using the Jobber Platform and the Services we provide.

1. Definitions

For the purposes of this document, the following terms have the meanings set out below:

"Jobber Platform" or "Platform" — the website www.jobber.md and all related subdomains, operated by JOBBER SPACE S.R.L.

"Services" or "Jobber Services" — the set of functionalities provided through the Jobber Platform, including the publication of job postings, access to the candidate database, matching services, the contact-data disclosure model (unlock model), receipt of direct responses from Candidates, and other functions described in this document.

"User" — any natural or legal person accessing and/or using the Jobber Platform.

"User-Candidate" or "Candidate" — a natural person using the Jobber Platform for the purpose of seeking employment.

"User-Employer" or "Employer" — a legal person or sole proprietor using the Jobber Platform for the purpose of publishing job postings and/or seeking Candidates.

"User Account" — an account created on the Jobber Platform, protected by a password, providing access to the Services.

"Disclosure Request (unlock-request)" — a request submitted by a User-Employer to obtain access to the contact data of a User-Candidate, in accordance with the disclosure model described in section 2.3.6.

"Direct Response" — an action of a User-Candidate whereby they apply for a specific vacancy published by a User-Employer, voluntarily disclosing their profile and contact data to the Employer.

"Matching Engine" — an automated system for matching Candidates to published vacancies, based on the analysis of competencies, experience, location, and other relevant criteria.

"IDNO" — the unique identification number of a legal person, assigned by the Agency for Public Services of the Republic of Moldova.

"Plan" — a package of services chosen by the User-Employer (FREE, STARTER, BUSINESS or PREMIUM), in accordance with the conditions of section 2.3.1.

"Subscription" — the period for which the User-Employer purchases a Plan (1, 3 or 12 months).

"Telegram Bot" — a communication channel via the Telegram application, used to deliver notifications to User-Candidates.

2. Jobber Services

The Services provided through the Jobber Platform are addressed to:

Users — natural persons visiting the Jobber Platform;

Users seeking employment ("User-Candidates");

Users — legal persons or sole proprietors wishing to publish job postings or to seek Candidates for specific positions ("User-Employers").

The Jobber Services are available exclusively through the website www.jobber.md and related subdomains.

2.1. Creation of a User Account, passwords and liability

User-Candidates may use certain functions of the Jobber Platform without creating an account.

To use all the Services provided by the Jobber Platform, Users (User-Candidates or User-Employers) must create an account on the Jobber Platform by completing the forms available in the interface of the "Create Account" section.

In the case of User-Candidates, account creation may also be carried out through a Facebook, LinkedIn or Google account.

Each User is obliged to provide only real, accurate and complete information when creating an account. In the event of a change to the information provided when creating an account, Users are obliged to update such data within 30 days from the date of the change.

Jobber reserves the right to refuse registration or to suspend the account of any User who has provided false, incomplete or inaccurate information, without prior notice.

Verification of companies upon registration. When registering a User-Employer account, it is necessary to enter the company's IDNO. The system automatically verifies the company's data through the public register of the Agency for Public Services (ASP) of the Republic of Moldova, automatically populating the company name, activity status, registration date and legal address.

If the IDNO is not found in the ASP register or the User-Employer is located outside the Republic of Moldova, registration through the standard form is unavailable, and the User must contact our Contact Center to obtain further instructions for verification. In this case, we may request additional documents confirming the existence and legitimacy of the company.

User-Employers are obliged to provide accurate information regarding the name, email address, telephone, first and last name of the contact person, and the identification code (IDNO). Legal persons — User-Employers having an active account on Jobber must be fiscally active.

Companies engaged in recruitment abroad are obliged to contact the Support service to provide documents confirming the licensing of such activity.

Jobber is not obliged to verify in advance the content of the information provided by Users when creating accounts; however, it reserves the right to verify any provided information subsequently and to take the necessary measures in the event that false, incomplete or inaccurate information is identified.

2.2. User-Candidates

User-Candidates may create an account only provided that, as of the date of account creation, they have reached at least 16 years of age.

Jobber is an online recruitment platform providing the possibility to create a professional profile (CV) in our database.

Assistance from Jobber consultants. As part of the Services provided, upon Your request (by email, telephone or through Telegram), we may offer optional assistance through our consultants. With Your express consent, one of our consultants may create an account on Jobber.md for You, prepare the necessary CV and, if You so wish, submit applications with Your CV to suitable vacancies. This assistance is provided free of charge and is optional.

Confidentiality model and transfer of data to the Employer. By default, the profiles of User-Candidates on the Jobber Platform are anonymized. The contact data of Candidates (full name, email, telephone, address) are not visible to User-Employers directly.

The profiles of User-Candidates are not available to User-Employers for free search or viewing in the form of a database. An anonymized Candidate profile may become visible to a User-Employer exclusively in one of the following ways:

through the automatic recommendations of the Matching Engine, generated on the basis of the vacancies published by that Employer;

as a result of a Candidate's direct response to a vacancy of that Employer.

The transfer of contact data to the Employer occurs only in one of two situations:

a) Direct response to a vacancy (inbound). You may apply directly to vacancies published on the Jobber Platform. By applying to a vacancy, You give Your express consent for the User-Employer who published that vacancy to obtain access to Your full profile, including contact data.

b) Disclosure upon the Employer's request (unlock model, outbound). When a User-Employer wishes to contact You, they submit a disclosure request (unlock-request). You receive a notification through the Platform's available communication channels (in particular, the Telegram Bot and/or email) and have 24 hours to accept or decline the request. In the event of acceptance — Your contact data are transferred to the Employer. In the event of decline or expiry of the 24-hour period — Your data remain confidential, and the request is cancelled.

In both cases, the transfer of data occurs upon Your action or consent, and not earlier.

Notification channels. The Jobber Platform uses the following notification channels for User-Candidates:

Telegram Bot — the main notification channel. By connecting Your account to the Jobber Telegram Bot, You will receive notifications about disclosure requests, vacancy recommendations and other relevant information in real time;

Email — notifications to the email address linked to the account.

The specific set of supported channels may expand as the Platform develops. Connecting the Telegram Bot is optional but recommended for an optimal Platform experience.

Access to the database. Jobber cannot guarantee that access to the database will not be restricted, or that the database will not be affected by technical factors. Jobber does not guarantee and bears no liability for the quality, integrity or relevance of the information in the database.

Disclaimer of liability. You must take into account that data disclosed by accepting a disclosure request or by submitting a direct response to a vacancy are transferred to User-Employers for recruitment purposes. Jobber cannot guarantee how User-Employers will use Your data after receiving them. We recommend that You report any abuse to support@jobber.md.

2.3. User-Employers

Jobber provides You with password-protected access to the User Account created on the Jobber Platform.

2.3.1. Plans and service packages

The Jobber Platform offers four tiers of plans for User-Employers. All prices are stated in Moldovan lei (MDL) inclusive of 20% VAT and are given for a 3-month subscription (base price). Multipliers for other periods — see section 2.3.4.

a) FREE — 0 MDL

Publication of vacancies on the Jobber Platform (maximum 2 active vacancies simultaneously);

Receipt of direct responses (inbound) from User-Candidates — Candidates' contacts are not visible;

0 (zero) disclosure requests (unlock-requests);

Viewing a summary of the number of suitable Candidates ("N candidates match Your vacancy"), without access to individual profiles;

No access to the Matching Engine selection (Candidates recommended by the Matching Engine).

b) STARTER — 1,099 MDL/month with a 3-month subscription (total 3,297 MDL for 3 months)

All functions included in FREE;

Up to 5 active vacancies simultaneously;

15 disclosure requests (unlock-requests) per subscription period;

Receipt of the Candidate's full CV (including contact data) upon each direct response (inbound) to a vacancy;

Possibility of anonymous publication of vacancies (without displaying the company name);

Access to the selection of Candidates recommended by the Matching Engine (anonymized profiles without compatibility percentage).

c) BUSINESS — 2,999 MDL/month with a 3-month subscription (total 8,997 MDL for 3 months)

All functions included in STARTER;

Up to 15 active vacancies simultaneously;

30 disclosure requests (unlock-requests) per subscription period;

Viewing of the "Candidate-vacancy" compatibility percentage (matching score);

HR-branding page on the Jobber Platform;

1 banner position in the relevant category;

1 social media promotion position (Facebook/Instagram);

1 organic publication position on TikTok.

d) PREMIUM — 5,999 MDL/month with a 3-month subscription (total 17,997 MDL for 3 months)

All functions included in BUSINESS;

Up to 50 active vacancies simultaneously;

50 disclosure requests (unlock-requests) per subscription period;

Priority delivery of Candidates recommended by the Matching Engine;

3 banner positions in the relevant categories;

3 banner positions on the home page;

Inclusion in the "Hot Vacancies" section;

Company logo in the "Top Companies" section;

3 social media promotion positions (Facebook/Instagram);

3 organic publication positions on TikTok;

3 organic publication positions on LinkedIn;

Dedicated support through an account manager.

Prices are stated inclusive of VAT (20%). All stated prices are expressed in Moldovan lei (MDL) and include value-added tax (VAT) at the rate of 20%.

Anonymous vacancies

User-Employers with a STARTER, BUSINESS or PREMIUM plan have the possibility to publish vacancies without displaying the company name.

In anonymous vacancies, the User-Employer may hide only the following fields:

Company name;

Company logo;

Exact legal address (in this case, the city or region remains mandatory for display).

In anonymous vacancies, the following remain mandatory for display:

City or region (at minimum — the city or the indication "remote work");

Industry / field of activity of the company;

Type of employment (full-time / part-time / project-based, etc.);

Description of duties and requirements for the Candidate;

Salary or salary range, or an explicit indication "negotiable".

Jobber reserves the right to verify anonymous vacancies and to request disclosure of the company name for internal verification purposes. The Candidate, upon accepting a disclosure request (unlock-request) or upon submitting a direct response, learns the real name of the company.

Jobber draws attention to the fact that anonymous publication of vacancies may significantly reduce the number of responses and the Candidate response rate.

2.3.2. Free access (FREE plan)

The FREE plan allows User-Employers to publish vacancies and receive direct responses from Candidates with anonymized personal data at no cost. The FREE plan does not include disclosure requests (unlock-requests) and does not provide access to the contact data of Candidates from the database.

The FREE plan is available to all User-Employers registered on the Jobber Platform, without time limit.

Jobber reserves the right to change the conditions of the FREE plan at any time with prior notice to the affected Users.

2.3.3. Use of Candidate data obtained through the Jobber Platform

By using the Jobber Services, the User-Employer obtains access to Candidate data exclusively for recruitment purposes. The User-Employer undertakes to use the obtained data (through accepted disclosure requests or through direct responses) exclusively for the purposes of the recruitment process and in accordance with the legislation on the protection of personal data.

The use of Candidate data for purposes other than recruitment is strictly prohibited, including but not limited to: direct marketing, resale of data, spam, or any form of unsolicited communication.

The User-Employer is responsible, as an independent data controller, for the processing of the personal data of Candidates obtained through the Jobber Platform, in accordance with applicable legislation.

The User-Employer expressly undertakes to: use Candidate data exclusively for recruitment for the vacancy in connection with which the data were obtained; not to transfer the data to third parties without a legal basis; not to use them for marketing, commercial profiling, resale, aggregation of databases, or unsolicited communications; to apply reasonable security and confidentiality measures; to restrict internal access to the circle of persons involved in the recruitment process; to delete or anonymize the data when they are no longer necessary for recruitment purposes or when the law does not justify their retention; to inform Jobber without undue delay of any security incident affecting data obtained through the Platform.

In the event of a breach of these obligations, Jobber may suspend or restrict the User-Employer's access to the Services, may block disclosure requests, and may require confirmation of the deletion of improperly processed data, without prejudice to other rights provided by law or by these Terms and Conditions.

2.3.4. Subscriptions, payments and transactions

Subscription periods

Access to the Services provided to User-Employers (with the exception of the FREE plan) is granted following the purchase of a subscription for one of the following periods:

All prices are stated inclusive of 20% VAT.

Payments and payment methods

All payments may be made online by bank card through the Paynet and/or MAIB payment processing systems. Payments are made in Moldovan lei (MDL).

User-Employers located abroad may make payments exclusively by bank card online.

Recurring subscriptions (auto-renewal)

Subscriptions are automatically renewed at the end of the chosen period by automatically charging the bank card linked to the account. The User-Employer will be notified at least 7 (seven) days before the automatic renewal of the subscription.

Cancellation of subscription

The User-Employer may cancel the automatic renewal of the subscription at any time by contacting our Contact Center. Cancellation takes effect at the end of the current subscription period. No refund is made for the remaining part of the current period (see below).

Refund

In general, no refund is made for purchased subscriptions, as subscriptions are purchased by legal persons within the framework of B2B relations, to which the consumer cooling-off rule does not apply.

Exceptions:

In the event of a technical failure on Jobber's side rendering the Services unavailable for more than 5 (five) consecutive business days, the User-Employer is entitled to a proportional refund for the days of downtime;

In cases expressly provided for by applicable legislation;

In other cases at Jobber's discretion (goodwill refund), without any obligation to provide such a refund.

Change of plan and cancellation of subscription

A change of plan (whether to a higher one — upgrade, or to a lower one — downgrade) and cancellation of a subscription may be initiated by the User-Employer at any time. The current paid plan continues to be in effect until the end of the current paid period. The new plan (or, in the case of cancellation, the FREE plan) takes effect from the next period. No proportional recalculation of payment by days within the current period is made, whether upon an upgrade, a downgrade, or a cancellation of the subscription.

Requests to change a plan or cancel a subscription are carried out by contacting our Contact Center.

Limit of disclosure requests (unlock-requests)

Disclosure requests (unlock-requests) included in a plan are valid exclusively during the current subscription period. Unused requests do not accumulate and are not carried over to subsequent subscription periods.

Change of prices

Jobber reserves the right to change the prices of the Services provided at any time. Price changes do not affect already paid subscriptions and take effect upon the next renewal of the subscription. Users will be notified at least 14 days before the new prices take effect.

Payment delays

In the event that it is impossible to process a payment for a subscription (for example, due to insufficient funds or the expiry of the card), access to the Services relating to the purchased plan will be suspended until the payment is made. Jobber will notify the User-Employer and provide a grace period of up to 2 (two) days to make the payment. Upon expiry of the grace period, the account will be transferred to the FREE plan until the moment the payment is successfully made.

2.3.5. User roles within an Employer account

Within a single User-Employer account, users with various levels of access may be assigned. Management of the subscription, billing and composition of the account's users is available exclusively to the User with the Owner role — the person who created the account or who received Owner rights from the previous Owner.

Other users of the account (hereinafter — HR users) obtain access to the functionalities of the Platform relating to the publication of vacancies, the sending of disclosure requests (unlock-requests), the viewing of Candidate profiles and the receipt of direct responses. The specific set of permissions of HR users is determined at the Platform level and may evolve as functionalities are added.

All actions of users within the account are considered actions of the User-Employer as a whole, and the Owner bears responsibility for compliance by all users of the account with these Terms and Conditions.

Disclosure requests (unlock-requests) and other plan limits are shared across the entire account, regardless of which specific HR user used them.

2.3.6. Contact-data disclosure model (Unlock)

The Jobber Platform uses a contact-data disclosure model that protects the confidentiality of User-Candidates and ensures a transparent process of connecting Candidates and Employers.

Disclosure process

Viewing of the anonymized profile. The User-Employer may view Candidate profiles recommended by the Matching Engine in anonymized form (without contact data). The volume of visible information depends on the chosen plan (see sections 2.3.1 and 2.3.7).

Sending a disclosure request. The User-Employer submits a disclosure request (unlock-request) for a specific Candidate, spending 1 (one) request from the limit available within the current plan. The request is reserved (not yet finally deducted).

Notification of the Candidate. The User-Candidate receives a notification through the Platform's available communication channels (Telegram Bot — only if it has been activated, email, web push or other available channels). The notification transmitted through external channels contains only the minimum information necessary to identify the request, whereas full details about the company name, vacancy title, city and salary (if stated) are available in the Jobber account.

Response period — 24 hours. The User-Candidate has 24 hours to respond to a disclosure request. During this period, the Candidate may:

Accept the request — in this case, the Candidate's contact data (full name, telephone, email) are disclosed to the User-Employer, and the disclosure request is finally deducted from the plan limit;

Decline the request — in this case, the contact data remain confidential, the disclosure request is returned to the Employer's plan limit, and the Candidate cannot be requested by the same company for 90 days (cooldown);

Not respond (timeout) — in this case, the disclosure request is returned to the Employer's plan limit, and the Candidate remains available in the database.

Candidate protection rules

In respect of a single Candidate, no more than 3 (three) disclosure requests may be active simultaneously. Requests submitted in excess of this limit are placed in a processing queue and are activated as the limit is freed up;

The same company may not submit a new disclosure request for the same Candidate earlier than 90 days from the moment of receiving from them a response (acceptance or decline) to the previous request. Where the previous request expired by timeout without a response from the Candidate (see below), the restriction does not apply;

Notifications to Candidates are delivered exclusively within the interval 08:00 — 20:00 local time of the Republic of Moldova (Chișinău).

Return of disclosure requests

In the event of a decline or expiry of the 24-hour period, the disclosure request is returned to the limit available to the User-Employer. A disclosure request is finally deducted only in the event of acceptance by the Candidate.

Prohibition of abuse

Jobber reserves the right to restrict the activity of User-Employers upon detecting suspicious use (attempts to circumvent the above-mentioned restrictions, use of the Platform for purposes other than recruitment, or other violations affecting the security of the Platform and the interests of other users).

2.3.7. Priority of Candidate delivery depending on the plan

The Jobber Platform uses an automatic Matching Engine that recommends relevant Candidates for published vacancies. Recommended Candidates are delivered to User-Employers depending on the chosen plan:

PREMIUM — priority delivery of Candidates. The User sees the full anonymized profile, including the compatibility percentage (matching score);

BUSINESS — delivery after Premium. The User sees the anonymized profile and the compatibility percentage (matching score);

STARTER — delivery after Business, without displaying the compatibility percentage. Candidates are grouped by profile freshness;

FREE — no access to the selection of Candidates recommended by the Matching Engine. Sees only a summary of the number of suitable Candidates.

This differentiation reflects the level of services included in each plan and is applied transparently. The specific timing parameters of delivery may be periodically adjusted by us to ensure optimal operation of the Platform. The Matching Engine uses the same objective matching criteria for all Candidates, regardless of the Employer's plan — the difference consists solely in the moment of delivery and the volume of information displayed.

2.3.8. Verification of companies

User-Employers are obliged to provide a valid and accurate IDNO code upon registration.

The Jobber Platform may verify a company's data through the public register of the Agency for Public Services (ASP) of the Republic of Moldova. Based on the results of the verification, data such as the company name and legal address may be automatically populated in the account; other available parameters (activity status, registration date) may be taken into account where available.

If the IDNO is not identified in the ASP register or the registering organization is located outside the Republic of Moldova, standard registration is unavailable, and the User must contact the Jobber Contact Center to obtain further instructions. Jobber reserves the right to request additional documents (certificate of registration, extract from the commercial register) to confirm the identity of the company.

If a company is identified as fiscally inactive, Jobber reserves the right to suspend or restrict access to the Services until the situation is clarified. The relevant check may be carried out automatically or by decision of the Jobber Contact Center.

The provision of a false IDNO code or one belonging to another legal person is a serious violation of these Terms and Conditions and may result in the immediate suspension of the account.

2.3.9. Communications via the Telegram Bot

The Jobber Platform may use the Telegram Bot as an optional communication channel with User-Candidates who have activated it. Through the Telegram Bot, Candidates may receive:

Notifications about disclosure requests (unlock-requests);

Recommendations of vacancies suitable for their profile;

Information about the status of applications;

Other relevant communications related to the Jobber Services.

Conditions of use:

Connection to the Telegram Bot is optional and is carried out via a link available in the User-Candidate's account;

The User-Candidate may disconnect the Telegram Bot at any time in the account settings or directly from the Telegram application;

Data transmitted through the Telegram Bot are limited to what is necessary for the notification and are processed in accordance with the Jobber Privacy Policy and the Telegram Privacy Policy;

Jobber does not have access to Users' private conversations in the Telegram application. Use of the Telegram Bot entails the transmission of the content of the notification through Telegram's infrastructure, within the limits of the functions described above and the consent provided by the User-Candidate.

2.4. Publication of CVs / job postings through the Jobber Platform

Responsibility for the content of job postings and CVs published on the Jobber Platform lies exclusively with the Users who have published them.

Jobber reserves the right to remove without prior notice any content that:

a. violates the applicable legislation of the Republic of Moldova or international standards in the field of human rights;

b. contains false, misleading or fraudulent information;

c. promotes discrimination on the basis of race, gender, sexual orientation, religion, nationality, disability, age, or any other characteristic protected by law;

d. contains vulgar language, threats, harassment or incitement to hatred;

e. violates the intellectual property rights of third parties;

f. contains personal data of third parties without their consent;

g. promotes illegal activity, including money laundering, tax evasion or human trafficking;

h. contains viruses, malware or other harmful components;

i. is unrelated to the purposes of the Jobber Platform (recruitment and job search);

j. contains links to sites with illegal, pornographic or harmful content;

k. violates any other provision of these Terms and Conditions.

3. Protection of the User Account

The User is solely responsible for maintaining the confidentiality of the password of their account. The User undertakes not to disclose the password to third parties and to take all necessary measures to protect their account.

In the event that the User suspects that their password has been compromised or that a third party has obtained unauthorized access to their account, the User must immediately notify Jobber at support@jobber.md and change the password.

Jobber bears no liability for losses or damages arising as a result of the User's failure to comply with the obligation to protect the password and the account.

4. Protection of intellectual property

The content of the Jobber Platform, including but not limited to: texts, graphics, images, logos, icons, software, databases, the structure of the site and the interface design, is protected by copyright and intellectual property legislation.

The use, copying, reproduction, modification, distribution or publication of any content of the Jobber Platform without the prior written consent of JOBBER SPACE S.R.L. is strictly prohibited.

The "Jobber" trademark and the associated logo are registered trademarks of JOBBER SPACE S.R.L. Their use without prior written consent is prohibited.

Users grant JOBBER SPACE S.R.L. a non-exclusive, royalty-free, worldwide license to use the content published on the Jobber Platform (CVs, job postings) for the purposes of providing the Services, including for the operation of the Matching Engine.

5. Protection of personal data

The processing of Users' personal data is carried out in accordance with the Jobber Privacy Policy, which is an integral part of these Terms and Conditions, as well as with the legislation of the Republic of Moldova on the protection of personal data, including Law No. 133/2011 — until the entry into force of Law No. 195/2024, and subsequently Law No. 195/2024, together with the GDPR to the applicable extent.

The Privacy Policy describes in detail: the categories of data processed, the purposes and legal bases of processing, the recipients of the data, the retention periods, the rights of data subjects and the means of exercising them.

Roles in data processing

JOBBER SPACE S.R.L. acts as a data controller in respect of the data provided by Users when creating an account, the data generated when using the Platform (including matching scoring data, unlock-requests, technical data) and payment data;

The User-Employer acts as an independent data controller in respect of the Candidate data obtained through the Jobber Platform (through accepted disclosure requests or direct responses). The User-Employer bears responsibility for the compliance of their own data processing with applicable legislation, including for informing Candidates, purpose limitation, data security, observance of retention periods, the handling of data subject requests and the notification of security incidents, where such an obligation is imposed on them by law.

Data Processing Agreement (DPA)

In cases where the relationship between Jobber and the User-Employer entails the processing of data as joint controllers or as a controller-processor, the parties conclude a separate Data Processing Agreement. User-Employers may request such an agreement at dpo@jobber.md.

6. Changes and suspension of access

Jobber reserves the right at any time to change, supplement or replace these Terms and Conditions, with notice to Users through the Jobber Platform and/or by email.

Changes take effect from the date of publication on the Jobber Platform, except in cases where a different date is indicated. Continued use of the Jobber Platform after the publication of changes is considered consent to the new Terms and Conditions, without prejudice to the specific requirements for separate consent to the processing of personal data, non-essential cookies or marketing communications where the law requires such consent.

Jobber reserves the right to suspend or terminate any User's access to the Jobber Platform and/or the Services without prior notice in the following cases:

a. the User violates these Terms and Conditions;

b. the User provides false, incomplete or inaccurate information;

c. the User uses the Jobber Platform in an abusive manner or for purposes contrary to its intended purpose;

d. there are reasonable suspicions of fraud, spam or illegal activity;

e. at the request of a competent authority;

f. in other cases provided for by applicable legislation.

Jobber reserves the right to temporarily or permanently suspend the operation of the Jobber Platform for the purpose of carrying out maintenance, updating or improvement work on the Services.

7. No warranties and limitation of liability

The Jobber Platform and the Services are provided "as is" and "as available", without any warranties, express or implied.

Jobber does not guarantee:

a. that the Jobber Platform will function without interruptions, errors or defects;

b. that the information provided through the Jobber Platform is accurate, complete or up to date;

c. that User-Candidates will find employment through the use of the Services;

d. that User-Employers will find suitable Candidates through the use of the Services;

e. that the results of the Matching Engine are accurate or complete — the compatibility percentage is an indicative measure, not a guarantee;

f. that the Services will satisfy the specific needs of Users.

Jobber bears no liability for:

a. direct or indirect losses incurred by Users as a result of the use of or inability to use the Jobber Platform;

b. the acts or omissions of other Users of the Jobber Platform;

c. temporary interruptions of the Services for technical reasons, maintenance reasons or force majeure;

d. content published by Users on the Jobber Platform;

e. loss of data caused by factors beyond Jobber's control;

f. the use of contact data obtained through the Platform by User-Employers in violation of these Terms and Conditions or applicable legislation, to the extent that such use was not caused by Jobber's fault.

In no event shall the total liability of JOBBER SPACE S.R.L. to a single User exceed the amount paid by that User to Jobber over the last 12 months preceding the event giving rise to the liability, except in cases where the limitation of liability is prohibited by law, including for breaches of mandatory obligations on the protection of personal data, intent, gross negligence, damage caused by a breach of data security through Jobber's fault, or other situations in which the law does not permit the exclusion or limitation of liability.

8. Force majeure

Neither party bears liability for the non-performance or delayed performance of its obligations in the event that such non-performance or delay is caused by a force majeure event.

"Force majeure" means any unforeseeable, insurmountable event beyond the control of the affected party, including but not limited to: natural disasters, wars, embargoes, acts of terrorism, epidemics, pandemics, failures of telecommunications infrastructure, decisions of public authorities, strikes or other disruptions of labor activity.

The party affected by a force majeure event must notify the other party within a reasonable time and take reasonable measures to minimize the consequences of the event.

9. Miscellaneous provisions

9.1. Amendment of the terms of this agreement

Jobber reserves the right to amend these Terms and Conditions at any time. The updated version is published on the Jobber Platform with an indication of the date of the last update. Users will be notified through the Platform and/or by email of material changes at least 15 days before they take effect.

9.2. Advertising and third-party content

The Jobber Platform may contain links to sites operated by third parties, or content provided by third parties. Jobber bears no liability for the content, privacy policies or practices of third-party sites or services. Access to third-party sites is at the User's risk.

9.3. Notices

Any notice or communication within the framework of these Terms and Conditions will be considered valid if transmitted:

by email to the address linked to the User's account (for notices to the User) or to support@jobber.md (for notices to Jobber);

by publication on the Jobber Platform;

through the Telegram Bot (for notices to User-Candidates who have activated this channel);

by post to the address of the registered office of JOBBER SPACE S.R.L.: str. Alba Iulia, 75, Chișinău, Republic of Moldova.

9.4. Governing law and jurisdiction

These Terms and Conditions are governed by the legislation of the Republic of Moldova.

Any dispute arising out of or in connection with these Terms and Conditions shall be resolved through negotiations. In the event that the parties have not reached agreement through negotiations within 30 days, the dispute shall be referred for consideration to the competent courts of the Republic of Moldova.

9.5. Severability

In the event that any provision of these Terms and Conditions is found to be invalid, unenforceable or null by a competent court, the remaining provisions retain their force and continue to be in effect.

9.6. Assignment

The User may not assign or transfer their rights or obligations under these Terms and Conditions without the prior written consent of JOBBER SPACE S.R.L. JOBBER SPACE S.R.L. reserves the right to assign or transfer its rights and obligations without the prior consent of the User in the event of a merger, acquisition or sale of assets.

9.7. Waiver of rights

Jobber's failure to exercise, or delay in exercising, any right or action provided for by these Terms and Conditions does not constitute a waiver of such right or action.
